Collaborative Law

An Alternative to Divorce

When couples begin to consider divorce, the threat of ongoing feuds, distraught children and mounting legal fees can undoubtedly conjure feelings of anxiety. For the many couples who face these challenges, fear of dealing with these elements only adds to the emotional turmoil they currently battle.

There is a quickly emerging practice in law that can alleviate those feelings and produce a more favorable outcome for all involved. Collaborative Divorce is an increasingly practiced method of handling divorce that puts parents and children in greater control of the outcome. It has become part of the growing discussion throughout popular culture, and its effectiveness is changing the way professionals handle divorce.

Instead of costly and time consuming litigation, many divorces can be handled in this newer, more compassionate method. The goals of Collaborative Divorce are to reduce or eliminate the need for a court to govern terms of agreement while maintaining a tone of respect and keeping children a top priority. Leaving these decisions up to strangers can create even more animosity and greater need for post-agreement modifications. By engaging in Collaborative techniques, all parties involved have control over major decisions like visitation, custody, holidays and all of the personal aspects involved in raising a family after divorce.

Lawyers who are trained in Collaborative Divorce work wholly in the best interest of the family and his or her client without being cornered into working a strategy. The negotiation involved is different from litigious, pre-trial negotiation. It considers needs and emotional safety as well as encouraging face-to-face conversations with the parties involved.

Most importantly, Collaborative Divorce cares for the children who often become victims of harsh, extensively litigated divorces. This method involves children in the discussion and provides coaches or child specialists if desired. These specialists are trained in these matters and can be built into an agreement that continues once the process is complete. Children often get caught in the cross-hairs of post-agreement disputes; Collaborative not only reduces the likelihood that modifications are necessary, but provides continued assistance from child specialists.

Overall, this method saves time, is cost-effective and mitigates the emotional expense of standard divorce practices. A lawyer trained in Collaborative Divorce can provide this service with skills and knowledge to guide the process and help all parties get to a better place.

Protect your Business

Protect Yourself and Your Business From the Start

"We all make mistakes"; easy to say but hard to deal with, especially where small business is concerned. As if working with the current economy and corporate competition wasn't enough, business owners may be their own worst enemies. Avoiding some common mistakes and keeping the following in mind may help alleviate some of the stresses involved with being your own boss.

  1. Don't expect instant success! We all hear the fairytales of overnight wealth, but stay realistic. The facts are that it can take between 15 and 20 years to see success as a SBO.
  2. Keep your competition in view:  losing sight of the competition and assuming your company holds the number one spot may leave you blindsided.
  3. Be a leader:  communicate with employees and inspire better work.
  4. Be realistic about financial goals:  avoid disappointment or overspending by following, "SMART":  specific, measurable, accountable, realistic and time-specific goals.
  5. Maintain the purpose:  losing focus can leave your team uninspired and unproductive. Regaining a sense of purpose can attract like-minded talent to your team.
  6. Develop a marketing strategy:  creating a cohesive message and branding will attract the business you are looking for.
  7. Be straightforward:  avoid leaving mistakes undisclosed; with the evasiveness of information sharing, allow your professionals to craft a message for the masses (not the other way around).
  8. Don't spread yourself thin:  as a leader, you have natural abilities that should be the focus of your energies. Surround yourself with a talented team and let your abilities work to their fullest.

It is very easy to get wrapped up in your business, especially if it becomes your passion. Don't allow your business to overwhelm the rest of your life. Planning a proper business structure and developing a strategy can make it possible for the success you are seeking

Accidental Landlords

Managing a Property has its Headaches

The booming market for rentals and the numerous financial benefits to being a landlord, especially when rents are on the rise, makes the job seem simple and profitable. However, landlords should keep in mind that adequate research must be done prior to posting the for-rent sign as the job can bring many legal responsibilities, expenses, and unforeseen headaches.

Managing a property could be a tough job; therefore Landlords should do everything they can to protect themselves from all the challenges they may face, including documenting everything as well as making sure to have a good contract that can be enforced in case an eviction is needed.

Stress-Free Holidays

Managing Stress This Holiday Season

The holiday season can become a very stressful time, and the joy of it all becomes lost in the shuffle.  Especially when trying to coordinate holiday parties, shopping for gifts, cooking, sending personalized holiday cards, and visiting family members in a short span of time.

Managing Stress during this time period can become an uneasy task. Here are a few suggestions to help you prevent stress this time of year:

Organization is key! Before you go hustling off in all directions, place yourself in a calm place and think about all your tasks. Write everything down and approach each task one at a time. Organizing your shopping list will also prevent stress and overspending.

Avoid last minute shopping: Try to do all your shopping early! This will eliminate long lines at the stores and most importantly make your shopping experience more pleasurable.

Prioritize your tasks: Prioritize your task list and don't worry about the next task until the first one is completed.  This will help keep you focused and prevent overwhelming.

Take some time to relax/meditate: It has been proven that taking some time during the day to meditate, even if just for a few minutes, will help restore your body to a calm state.

Have fun with it: Don't forget that the holidays are supposed to be a happy, stress free time of year. Don't put too much pressure on yourself, and try to enjoy the festive season.

A Modest Proposal For Immigration:

The $100,000 Green Card

Many potential immigrants from around the worlds dream of acquiring permanent residence in the USA and become valuable members of American society. Nevertheless, there are two common objections: the immigrants will either drive down wages, or they will be a drain on tax-funded programs.

So if that's the issue, why not give them the option to pay this tax and end the wait? What if anyone under age 50 paid a $100,000 fee toward the retirement of the US public debt, satisfied the usual anti-criminal criteria, and got their green card.
